MEDIATION
Unfortunately,the litigated divorce often results in the children, who are innocent victims becoming embroiled
in their parents' anger . Mediation is an alternative form of peaceful dispute resolution that helps
couples, partners, former couples (post divorce), and co-parents resolve disputes cooperatively. The mediator does not advocate
for or represent either party , and is a neutral third person who assists them in resolving issues such as division of real
or personal property, the marital home, assets, debts and parental responsibility ("custody"). We can also help
to resolve various post- divorce issues such as child support arrears or modification of time-sharing(custody).Our
firm will mediate cases for individuals unrepresented by attorneys, and provide you with all of the necessary divorce paper
work that you will require in order to dissolve your marriage.
As mediators, our job is not to advocate for either client , or to act in the capacity of a Judge . We do
not dictate to you , or tell you what you must do. You maintain control over the ultimate decision
making process. A mediator helps you explore options , and suggests creative solutions. Most people think that a Judge
will rule in their favor. Unfortunately, the law is not always as black and white as we would like it to be. With family
law in Florida, the decision making power is vested in the trier of fact, a Judge who may rule in favor of either pary.
The advantage of resolving your disputes through mediation, is that you make the decisions and ultimately there is
more certainty and control.
Another
advantage to mediation, is that it expedites the process. Litigated divorces can drag on for years, exacting an emotional
toll on the parties, and more importantly, on your children. For instance, how can a parent devote their full and undivided
attention to their children, when contentious legal proceedings are a constant distraction and menace to their emotions? Children
often become immersed in the tug of war between their parents. If one party "wins", the real losers are the children
and not the other parent.
Mediation is also an affordable , and low-cost way to secure a divorce .
Mediation is not suitable in every case. The parties must be open to the idea of the possibility of settlement. Further,
they must be capable of engaging in fair and uncoerced bargaining.
